These Terms of Use ("Terms") are an agreement between you and LoonForge LLC, a Delaware limited liability company ("LoonForge," "we," "us," or "our"). They govern your use of our websites, online stores, and applications, including loonforge.com, the Loon & Co. website and store, the SketchForge application, and any other site or app that links to these Terms (together, the "Services").
By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. Some features — such as purchases or specific apps — may have additional terms presented at the time of use; those additional terms control if they conflict with these Terms.
You must be at least 13 years old to use the Services, and at least 18 (or the age of majority where you live) to make a purchase. If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and tell us promptly at hello@loonforge.com if you suspect unauthorized use.
Some Services let you upload or create content — for example, sketches, images, and design files you submit to SketchForge ("User Content"). You keep ownership of your User Content.
So that we can operate the Services, you grant LoonForge a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, transform, and display your User Content as needed to provide, secure, and improve the Services — for example, converting a sketch you upload into a printable 3D model, generating previews, or making backups. This license ends when your User Content is deleted from the Services, except for copies retained in routine backups or as required by law.
You are responsible for your User Content. You represent that you own it or have the rights needed to use it and to grant us this license, and that it does not infringe anyone else's intellectual property or other rights.
If you send us feedback or suggestions, we may use them without restriction or obligation to you.
Some Services generate outputs from your User Content, such as 3D model files ("Outputs"). As between you and LoonForge, and subject to these Terms, you may use Outputs generated from your own User Content. You are solely responsible for how you use Outputs — including printing, distributing, or selling physical objects made from them — and for ensuring that use does not violate any law or infringe any third party's rights. Similar or identical outputs may be generated for other users from similar inputs, and no exclusivity is promised.
The Services — including software, text, graphics, product designs, logos, and trade dress — are owned by LoonForge or its licensors and are protected by intellectual property laws. LoonForge, Loon & Co., SketchForge, and our logos and distinctive brand elements are trademarks of LoonForge LLC. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. No other rights are granted, and you may not use our trademarks without our prior written permission.

Prices, products, and availability may change at any time without notice. We may correct pricing or description errors, and we may cancel or refuse an order — including after it is placed — in which case we will refund any amount you paid for the canceled order. Applicable taxes and shipping charges are added at checkout. Estimated shipping and production times are estimates only, especially for handmade and made-to-order items.
Return and exchange terms are stated at the point of sale. Unless stated otherwise there, custom, personalized, and made-to-order items are final sale. Nothing in this section limits rights you may have under applicable consumer protection law.
Our physical products include handmade jewelry and 3D-printed items, which naturally vary in color, texture, and finish; small variations are part of the craft, not defects. Please note:
The Services may link to or work with third-party websites and services (for example, expertlysimple.io, payment processors, or app stores). We are not responsible for third-party services, and your use of them is governed by their own terms and policies.
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT OUTPUTS WILL MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) LOONFORGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES; AND (B) LOONFORGE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless LoonForge and its members, officers, and agents from and against claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Services or Outputs, or your violation of these Terms or of any law or third-party right.
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at hello@loonforge.com and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Maryland, and you consent to their jurisdiction. Nothing in this section prevents either party from seeking relief in small-claims court or prevents you from exercising non-waivable rights under the law of the place where you live.
You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the Services. Sections that by their nature should survive termination (including Sections 3–5 and 10–13) will survive.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
These Terms, together with the Privacy Policy and any additional terms presented in the Services, are the entire agreement between you and LoonForge regarding the Services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
